Process -- amendment of summons to conform to complaint. Where inadvertently the name of a defendant is omitted from the title of the action in the summons, but appears in the title of the action in the complaint attached to and personally served on such defendant with the summon, said complaint stating a cause of action against him by name, the court properly amended the summons so as to conform to the complaint on plaintiff's motion made and heard simultaneously with defendant's special appearance to vacate the service of summons on the ground that he was not named as a defendant therein.
